'Agunah and the Problem of Authority'

-----------------------

David Epstein

The Jewish Chronicle of 30 August reported that Dayan Ehrentreu will be
continuing his position at the London Bet Din. Commenting on the Agunah issue, the Dayan is reported to have said, “If there was a loophole, we would have found it by now”. We think he’s effectively saying, “If it hasn’t been done already, that means it can’t be done.”

The same piece also noted his support for the Eruv (the symbolic
enclosing of a geographical area) in North West London to permit
observant Jews to carry and wheel pushchairs (or alternatively, push
wheelchairs) on Shabbat while still obeying the rules. This has notbe
been done before in London (though Eruvim do exist elsewhere).

However, Dayan Ehrentreu does not seem to feel “If it hasn’t been done
already, that means it can’t be done” applies to the Eruv, even if it
does apply to doing anything Halachic about solving the Agunah problem.
